EXAMINATION OF THE ACCUSED FRITZ DAVID (KRUGLYANSKY)

At the evening 開会／開廷／会期 of August 21, the last of the （刑事）被告, Fritz David (Kruglyansky), is 診察するd.

Fritz David was sent to the Soviet Union by Trotsky as a テロリスト with 指示／教授／教育s to make an 試みる／企てる on the life of Comrade Stalin. In reply to a question put to him by the 大統領 of the 法廷，裁判所 the （刑事）被告 確認するs his 証言 as to the 指示／教授／教育s he received 本人自身で from Trotsky in Copenhagen. In order not to expose the 地下組織の Trotskyite organisation to any 危険, Fritz David did not 設立する 接触する with anybody in the U.S.S.R. except with Berman-Yurin. This, 宣言するs the （刑事）被告, was in pursuance of the direct 指示／教授／教育s of Trotsky.

Replying to questions put to him by Comrade Vyshinsky, Fritz David gives to the 法廷，裁判所 a 詳細（に述べる）d account of how in August 1932 he 設立するd 接触する with Sedov, and, through the latter, with Trotsky.

Vyshinsky:  When did you 会合，会う Trotsky?

Fritz David:  I met him at the end of November 1932.

Vyshinsky:  How did you come to him?

Fritz David:  I travelled on a 誤った パスポート. In one of the conversations I had with Sedov he told me that Trotsky was to come to Europe and would like to see me.

Vyshinsky:  Tell me, during that 会合 with Trotsky, was there talk of テロ行為?

Fritz David:  There was.

Vyshinsky:  On whose 率先?

Fritz David:  On Trotsky's 率先.

In his 証言 regarding the content of his conversation with Trotsky, Fritz David 宣言するs that Trotsky said that the advent of the Trotskyites to 力／強力にする in the U.S.S.R. was possible only if Stalin were 肉体的に destroyed.

One of the prospects put 今後 by Trotsky was to take a defeatist 態度 in the event of war, but he 強調する／ストレスd the point that "there is a closer prospect of Trotskyites coming to 力／強力にする - the prospect of the physical 除去 of Stalin."

Vyshinsky:  What was your 態度 toward this idea?

Fritz David:  I 受託するd this second prospect.

Vyshinsky:  Did you tell him so - that you 受託するd this line, that you agreed?

Fritz David:  Yes.

Vyshinsky:  What else occurred?

Fritz David:  Then Trotsky gave me two 指示／教授／教育s. The first 指示／教授／教育 関心d secrecy.

Vyshinsky:  You told him you would 請け負う a terroristic 使節団?

Fritz David:  Yes. He 提案するd that I go to the U.S.S.R. and 本人自身で commit a terroristic 行為／法令／行動する, without the 援助（する） of others, without any organization, without 接触するs with other Trotskyites.

Vyshinsky:  And that is what the 指示／教授／教育 関心ing secrecy 量d to?

Friz David:  Yes. Trotsky told me that this 事件／事情／状勢 伴う／関わるd 危険 and that there was no point in exposing the Trotskyite organization in the U.S.S.R. to that 危険. The second 指示／教授／教育 was to the 影響 that this terroristic 行為／法令／行動する was to 耐える an international character, was to be committted at an international 議会. This 発射, as Trotsky 表明するd it, was to reverberate through out the whole world.

Vyshinsky:  Did your conversation end at that?

Fritz David:  Our conversation, which was a very long one ended at that. Besides, Trotsky said, for example, that talk about individual terror not 存在 両立できる with Marxism was a 支配する for the philistines of Marxism.

Vyshinsky:  What other 指示／教授／教育s did Trotsky give you?

Fritz David:  Trotsky 教えるd me to behave in the U.S.S.R. in such a way as not to show any deviations from the general line of the Party, and when 令状ing for the 圧力（をかける） to 固執する 厳密に to the Party line, and under no circumstances to 明らかにする／漏らす the threads after the terroristic 行為／法令／行動する was committed.

Friz David arrived in the U.S.S.R. in March 1933 and met Berman-Yurin who sought him out on Sedov's 指示／教授／教育s. Fritz David and Berman-Yurin drew up two 固める／コンクリート 計画（する）s for 試みる／企てるs on the life of Comrade Stalin; the first was to be made at the Thirteenth 総会 of the E.C.C.I., the second at the Seventh 議会 of the Comintern. Both 計画（する）s failed, because Comrade Stalin did not …に出席する the Thirteenth 総会, while only Fritz David was able to get into the 議会 of the Comintern, since he had failed to 得る a ticket for Berman-Yurin. Fritz David, によれば his 声明, was unable to commit the terroristic 行為／法令／行動する because it was impossible to get 近づく Comrade Stalin.

Vyshinsky:  So you 伸び（る）d 入ること／参加（者） to the 議会?

Fritz David:  Yes, I was at the 議会.

Vyshinsky:  Why was the terroristic 行為／法令／行動する not committed?

Fritz David:  The 起訴，告発 やめる 正確に 明言する／公表するs that I was not able to get 近づく Stalin.

Vyshinsky:  You went to the 議会 to make an 試みる／企てる at 暗殺?

Fritz David:  Of course.

After the Seventh 議会 messengers from Trotsky's son, Sedov, visited Fritz David on two occasions, and in Sedov's 指名する （刑事）被告 the テロリストs of not 存在 十分に active and ordered them to 速度(を上げる） up the terroristic 行為／法令／行動する in 一致 with Trotsky's 指示／教授／教育s.

Vyshinsky:  These 会合s took place on the basis of your terroristic 計画（する）s?

Fritz David:  These 会合s were 原因（となる）d by the fact that the terroristic 行為／法令／行動する was not committed at the Seventh 議会, and this made Sedov furious.

Vyshinsky:  But did you terroristic disposition pass away after this, or did it continue until やめる recently?

Fritz David:  Yes it continued.

Vyshinsky:  Until when?

Fritz David:  Until my 逮捕（する）.

Vyshinsky:  So we may sum up. You were a member of the Trotskyite organization and met Trotsky 本人自身で. Trotsky 本人自身で （売買）手数料，委託（する）／委員会／権限d you to go to the U.S.S.R. to commit a terroristic 行為／法令／行動する and 警告するd to 観察する strict secrecy. That explains why you made no 接触するs with any other members of the Trotskyite organization except Berman-Yurin. Together with Berman-Yurin, who had received analogous 指示／教授／教育s, you made 準備s for an 試みる／企てる on the life of Comrade Stalin, タイミング it for the Seventh 議会 in 1935. Thanks to the 接触するs you had in the Comintern you 本人自身で 伸び（る）d 入ること／参加（者） to the 議会 ーするために commit this 行為／法令／行動する, but you failed to do so 借りがあるing to circumstances over which you had no 支配（する）／統制する.

Fritz David:  I question this last point somewhat, not ーするために 最小限に減らす my 犯罪, but 簡単に to 現在の the whole picture.

Vyshinsky:  Then let's say: 借りがあるing to 客観的な circumstances?

Fritz David:  借りがあるing to 客観的な and subjective factors.

Vyshinsky:  But you will not 否定する the 告発（する），告訴（する）／料金 against you that you failed to commit the 行為／法令／行動する because you could not get nearer to the 壇・綱領・公約 and had no chance to get 近づく Comrade Stalin?

Fritz David:  That was one of the 推論する／理由s

Vyshinsky:  Yes, one of the 推論する／理由s, but an obvious, 客観的な 推論する／理由. All the 残り／休憩（する） is mere psychology.

This 結論するs the examination of the （刑事）被告 Fritz David.

After the examination of the （刑事）被告 at the evening 開会／開廷／会期 of August 21, Comrade Vyshinsky, 明言する／公表する 弁護士／代理人／検事 of the U.S.S.R. makes the に引き続いて 声明:

"At 先行する 開会／開廷／会期s some of the （刑事）被告 (Kamenev, Zinoviev and Reingold) in their 証言 referred to Tomsky, Bukharin, Rykov, Uglanov, Radek, Pyatakov, Serebryakov and Sokolnikov as 存在 to a greater or lesser degree 伴う／関わるd in the 犯罪の 反対する-革命の activities for which the （刑事）被告 in the 現在の 事例／患者 are 存在 tried. I consider it necessary to 知らせる the 法廷，裁判所 that yesterday I gave orders to 学校／設ける an 調査 of these 声明s of the （刑事）被告 in regard to Tomsky, Rykov, Bukharin, Uglanov, Radek and Pyatakov, and that in 一致 with the results of this 調査 the office of the 明言する／公表する 弁護士／代理人／検事 will 学校／設ける 合法的な 訴訟／進行s in this 事柄. In regard to Serebryakov and Sokolnikov, the 調査／捜査するing 当局 are already in 所有／入手 of 構成要素 罪人／有罪を宣告するing these persons of 反対する-革命の 罪，犯罪s, and, in 見解（をとる） of this, 犯罪の 訴訟／進行s are 存在 学校／設けるd against Sokolnikov and Serebryakov."

At the end of the evening 開会／開廷／会期 of August 21, the （刑事）被告 Dreitzer, replying to questions put to him by Comrade Vyshinsky 関心ing 確かな 詳細（に述べる）s of the 反対する-革命の activities of the Trotskyite-Zinovievite centre, 宣言するs that one of the active 関係者s in the terroristic work of the Trotskyites was Putna, an old and active Trotskyite. によれば Dreitzer, Putna at one time 表面上は left the Trotskyites in pursuance of the line of 二塁打-取引，協定ing, but 現実に continued until やめる recently to carry on stricly secret work for the Trotskyite centre. In particular, Dreitzer 証言するs that Putna had direct 接触する with Trotsky, met I. N. Smirnov, and in 1932 communicated to Smirnov, through Dreitzer, Trotsky's 言葉の 指示／教授／教育s to 組織する テロリスト groups. The （刑事）被告 Smirnov tries to 否定する the fact that Putna 参加するd in the terroristic activity of the Trotskyites. However, in reply to questions put to them by Comrade Vyshinsky, the （刑事）被告 Pickel, Reingold and Bakayev 確認する Dreitzer's 証言.

On the 結論 of the examination of the （刑事）被告, Comrade Ulrich, 大統領 of the 法廷，裁判所, 宣言するs the 法廷，裁判所 調査 ended.
