DECEMBER 28TH: 推論する/理由 勝つ/広く一帯に広がるd! This was the judgment of most commentators after the WIPO 会議/協議会 in Geneva had finished on December 20th. 委任する/代表s decided not  to 可決する・採択する the 議論の的になる article 7. "一時的な" and "indirect" reproduction, について言及するd in the 提案, are 現実に covered in article 9 of the old Berne 条約, a fact many of the 対抗者s also had pointed out.

The 条約 on 知識人 所有物/資産/財産 権利s in Databases was 延期するd in its entirety, so the 可決する・採択するd 条約s were The Copyright 条約 and The 業績/成果s and Phonograms 条約.

One might say status quo was 達成するd, and yet this must be regarded as a victory. Things could have turned out really bad. Powerful lobbyist groups with little or no knowledge of the idiosyncrasies of new マスコミ might have won a short-称する,呼ぶ/期間/用語 victory, that in the long run would have become truly counterproductive. Much of today's and tomorrow's creative and 科学の work - carried out on a 全世界の and 事実上の 円形競技場 - would 大部分は have been 妨害するd by the ーするつもりであるd, rigid 法律制定. Now, the public's and the 使用者s' 状況/情勢 has at least not changed for the worse. The question, however, is whether the harmonisation that has now been 輪郭(を描く)d, will 十分である in our 全世界の 網状組織ing society.

This 会議/協議会 was in itself indicative of how new マスコミ in 確かな 尊敬(する)・点s break up 国家の 境界s - a direct answer to new 全世界の needs as it was. But the 会議/協議会 and the (選挙などの)運動をするs in 関係 with it also point at another important 傾向: Within the field of electronic publishing, 消費者s more and more become 生産者s 同様に. We all know that the computer is a machine for both 令状ing and reading, for both receiving and 配当. Therefore, it is not surprising that also a few 伝統的な 観念的な 前線 lines have become blurred. Many organisations, 当局, companies and individuals have taken a 見地 in the WIPO 問題/発行する contrary to what could have been 伝統的に 推定する/予想するd. That is a really good omen.



Will copyright WIPE out
the WWW this winter?

DECEMBER 19TH: It has been remarkably silent lately on the 逮捕する. Remember when there used to be 黒人/ボイコット pages and blue 略章s almost everywhere? In August this year, the international copyright organisation WIPO 現在のd its 提案 for an addendum to the copyright 法律制定 in the Berne 条約. A 決定/判定勝ち(する) is now 急いでd - and should かもしれない be made in Geneva between December 2nd and 20th.

Now, what has happened since November the 14th, when the special Art 貯蔵所 問題/発行する was 解放(する)d?

On November 22nd, the American 国家の Writers Union made a 声明 against the WIPO-提案 and 示唆するd that the 決定/判定勝ち(する) should be 延期するd until the question has been discussed 完全に with all parties 関心d.

In this 声明, the NWU 発言/述べるs that "our 見解(をとる)s may not be considered 伝統的な for copyright 支えるもの/所有者s". This is true. 特に in Sweden many unions believe that those who 非難する the WIPO-提案 want to 否定する artists or writers 支払い(額) for their work. But of course such reasonable 需要・要求するs must be 重さを計るd against the 権利s of the 使用者s/readers/テレビ視聴者s, 権利s which up till now has been taken for 認めるd:

"明確に, the 全世界の (警察などへの)密告,告訴(状) 組織/基盤/下部構造 has the 可能性のある to reshape our culture and nearly every 面 of our lives. For that 推論する/理由, we must 発言する/表明する 関心s that 好意 the 権利s of (警察などへの)密告,告訴(状) 使用者s at the same time that we 捜し出す fair 補償(金) for our work," says the 国家の Writers Union in their 声明, which is 利用できる on http://www.nwu.org/nwu/anc/wipo1.htm

Publisher Bloomberg L.P. also wrote a 抗議する letter on November 22nd. Mr Michael Bloomberg (人命などを)奪う,主張するs that he is unaware of any commercially 重要な piracy of US-owned databases, that would be meaningfully 減ずるd by 早期に 採択 of the 提案するd 条約.

The organization EBLIDA was 設立するd in the 早期に 90's to fight a 提案 within the EU that public libraries would no longer be permitted to lend 調書をとる/予約するs without 許可 from the authors. EBLIDA has made its position (疑いを)晴らす in a 声明 利用できる at http://www.kaapeli.fi/~eblida/eblidapos.htm

On December 5th James Love, director of 消費者 事業/計画(する) on 科学(工学)技術 中心 for 熟考する/考慮する of Responsive 法律 in Washington, talked to the 圧力(をかける):

"The 会議/協議会 組織者s are deliberately 誤って導くing the public about the status of copyright 法律 on the Internet," Mr Love said. "Some 圧力(をかける) 要点説明s 暗示する that without the 条約s, はびこる 違反s of copyrighted 作品 would be 合法的な. This is patently 誤った. 法廷,裁判所s routinely hear 事例/患者s about the 使用/適用 of 現在の copyright 法律s on the Internet. New 問題/発行するs are raised, and these 問題/発行するs are 解決するd through normal 法廷,裁判所 過程s. These 条約s are not designed to bring copyright to the Internet. They are designed to change copyright 法律, and to create very 制限する 支配するs for the use of (警察などへの)密告,告訴(状)."

"The 条約s are so 貧しく conceived as to raise questions about the competence of the drafters. People are alarmed that the drafters do not understand computers or the Internet.", James Love 発言/述べるd.

Several service providers - Compuserve, AOL, Prodigy, Bell and others - wrote a letter 直接/まっすぐに to 大統領,/社長 Clinton on December 10th, where they 表明するd their 関心s about the consequences of the WIPO-提案.

A couple of days of pure 形式順守s passed before actual discussions began in Geneva. But then some 委任する/代表s 反対するd to the idea that selling 器具/備品 that might be used to 回避する copyright 保護, should be considered 違法な. This would, of course, turn each and every computer reseller into a 犯罪の.

In the first 審議 on the 決定的な question about reproduction, the chairman - and a few others - (人命などを)奪う,主張するd that the 権利 to make copies for personal use and the 権利 to browse - at libraries or on the 逮捕する - is more or いっそう少なく implicit. 委任する/代表s from Singapore and Denmark 示唆するd that this should be explicitly written in the text, but many 委任する/代表s felt that this would be unnecessary. Henry Olsson from Sweden said that the Swedish 政府 finds it difficult to 受託する that reproduction 現実に occurs in all instances that the 提案 明示するs.

Around the 16th-17th, more and more 委任する/代表s began showing 調印するs of 強調する/ストレス. Bruce Lehman, Commissioner of the 特許 and Trademark Office in the U.S., said that at least the database 条約 will probably have to be 延期するd.
