YOU COULD NOT SHARE  an 利益/興味ing newspaper clipping in electronic form with a friend, and you could not re-check something you read in a 数字表示式の 調書をとる/予約する of your own - without 支払う/賃金ing for a second look. You who are reading this are probably 公正に/かなり used to surfing the Internet. Even if the 称する,呼ぶ/期間/用語 "surfing" has a somewhat superficial sound to it and will, perhaps, be 取って代わるd by a more 組織するd and pointed 追求(する),探索(する) for knowledge, this basic tenet of the World Wide Web remains: すなわち, to be able to move seamlessly between a 網状組織 of cross 言及/関連d texts, pictures and perhaps even sound and ビデオ.

At this point, we are rather tired of deceptive metaphors such as infobahn and the electronic superhighway, since they are, 自然に, just as static and inflexible as their analog 同等(の)s. Still, the similarities are plausible in one 尊敬(する)・点: すなわち that one can move about, just as in a city or on a country road, peering into storefronts and 熟考する/考慮するing posters outside a theater or museum.

The limitless 可能性s of window shopping that the real world 供給するs have, thus far, been 首尾よく transferred to the 数字表示式の realm. It has been taken for 認めるd that one can move from one place on the World Wide Web to another, partaking of the images and text 供給するd, and for the most part, 完全に for 解放する/自由な.

Now, however, this basic tenet of the World Wide Web is 存在 脅すd. In a 提案するd 拡大 of the Berne 条約, the 部隊d Nation's World 知識人 所有物/資産/財産 Organization (WIPO) has 示唆するd a 乱すing new 鮮明度/定義 of what defines reproduction. によれば the WIPO 鮮明度/定義, reproduction is 生成するd every time something is copied to computer memory, even if these copies are only extant for a couple of seconds.

The WIPO 提案 also places a かなりの level of 責任/義務 upon Internet service providers to 確実にする that their servers do not 含む/封じ込める 違法な copies which would 伴う/関わる copyright 違反s. The difficulty of 監督するing continually changing 団体/死体s of (警察などへの)密告,告訴(状), 含む/封じ込めるing many gigabytes, has been 以前 discussed and, it was thought, 解任するd from 現在の 審議.

In 新規加入, 支配するs regarding copyright for databases, in their 機能(する)/行事 as collections or 編集s, are to be drawn up, as are 支配するs for how extraction should be 裁判官d.

These 提案s have 原因(となる)d a sort of subdued 激しい抗議 の中で the world's 使用者s (those people who partake of the (警察などへの)密告,告訴(状) and are not copyright 支えるもの/所有者s), 含むing individuals, librarians and さまざまな distributors of electronic (警察などへの)密告,告訴(状). Many do not really dare to believe what they hear, both because the 提案s are 極端に vague, leaving the field wide open for さまざまな 解釈/通訳s, and because there is such an incredibly short period of time to discuss the 問題/発行する. The 提案 has only been in its final form since August, and a 決定/判定勝ち(する) is going to be made already in December 1996.

The Internet community has not 反応するd as 堅固に as to earlier 脅しs, like 大統領,/社長 Clinton's encryption 半導体素子 or the Communications Decency 行為/法令/行動する. Does anyone remember the fight about the GIF 数字表示式の image 判型 in January '95? All of a sudden Compuserve and Unisys 手配中の,お尋ね者 事実上 everyone who 扱うd GIF images to 支払う/賃金 王族 to Unisys, who had developed the compression algorithm at work in this 数字表示式の 判型. The Internet community fought 支援する very efficiently, and invented a new 判型 (GEF), that could 取って代わる GIF if need be. If so, did they learn anything?

A New Reproduction With Each 見解(をとる)ing

によれば Article 7 of the WIPO 提案, every copy that is made, "in any manner or form," is considered a reproduction. The commentary 明らかにするs this to mean that any "direct or indirect" copying, either "永久の or 一時的な" 構成するs reproduction. In comment 7.05 it says 特に: "It may 同様に be a copy of the work on the hard disk of a PC, or in the working memory of a computer."

見解(をとる)ing a picture on a Web page 伴う/関わるs downloading it into one's own 内部の computer memory in order that it may be 見解(をとる)d on the 審査する. This is, in fact, a 必要物/必要条件 to 利用する anything 数字表示式の, be it from the 逮捕する, from a CD-ROM or from a floppy disk. (警察などへの)密告,告訴(状) must be 解釈する/通訳するd in a way that is 理解できる to humans (i.e. letters and words in a recognizable language, or forms and colors for images), and this can only be done using some form of 器具/備品 that 監督するs and 保持するs that which is 存在 過程d. In other words, some form of memory, a computer memory, is 要求するd.

By 鮮明度/定義, the reading of 数字表示式の (警察などへの)密告,告訴(状) 要求するs that the (警察などへの)密告,告訴(状) be copied into a computer memory, even if that (警察などへの)密告,告訴(状) only 存在するs in the memory for a few seconds. It is this fact that the copyright lobbyists now have discovered. They perceive that money is slipping through their fingers. But they probably do not fully perceive the consequences of the 提案するd new copyright 法律制定 that they have been party to 明確に表すing, nor how 反対する 生産力のある it is over the long 称する,呼ぶ/期間/用語.

Americans probably 認める the WIPO 提案. It is 概略で the same ideas as in the 提案するd 1995 House 法案 - The 国家の (警察などへの)密告,告訴(状) 組織/基盤/下部構造 Copyright 保護 行為/法令/行動する - which was 延期するd last spring. Now, through international organizations, this 提案 is revisiting America - and the 残り/休憩(する) of the world.

It is (疑いを)晴らす from Article 10, "The 権利 of Communication", that it is difficult to distinguish between 配当 and reproduction in the 数字表示式の world - and that the people behind the WIPO 提案 are 用意が出来ている to make the most of this. There are even glimpses here of a return to the 見解(をとる) that, for example, 正規の/正選手 見解(をとる)ing of a ビデオ 記録,記録的な/記録するing of a television program for 私的な use is something that cannot occur without the 許可 of the copyright 支えるもの/所有者.

In 1984, 全世界の/万国共通の and Walt Disney 生産/産物s unsuccessfully tried to 告訴する Sony for complicity in copyright 違反s because it was selling Betamax ビデオテープ recorders, with which television could be 記録,記録的な/記録するd, 容易にするing the reproduction of the film company's work. The 部隊d 明言する/公表するs 最高裁判所, however, 支配するd that there was 合法的 "fair use" for "time-changing 目的s." (Article 3 of the WIPO 提案 is somewhat 乱すing in this regard: "When literary or artistic 作品 are made 利用できる to the public by wire or wireless means in such a way that members of the public may 接近 these 作品 from a place and at a time 個々に chosen by them, [...] 契約ing Parties shall, [...] consider such 作品 to be published 作品.")

There is, however, still a (疑いを)晴らす distinction between a picture on a TV 審査する and a picture on a computer 監視する, にもかかわらず both of them consisting of cathode ray tubes. In the one 事例/患者, a computer memory is 伴う/関わるd, in the other it is not. A ビデオテープ can be replayed at home an innumerable number of times. One has 購入(する)d the 権利 to see it as often as one wishes, without その上の cost, so long as one does not, for example, arrange showings for the whole 近隣 and 告発(する),告訴(する)/料金 admission. The same film shown digitally on a computer 審査する will, however, mean a new "reproduction" is created every time it is shown. As a result, it must be accounted for.

In the 早期に 90's, new 支配するs for printed 作品 were 提案するd within the European Union: public libraries would no longer be permitted to lend 調書をとる/予約するs without 許可 from the author. Each library would have been 軍隊d to draw up 契約s with each and every author, almost like a publisher. The organisation EBLIDA was formed to fight against this 提案 - and it was stopped. Now, however, 類似の ideas are haunting the 数字表示式の world.

以前, copyright questions were まず第一に/本来 something that 関心d 生産者s of 調書をとる/予約するs, 記録,記録的な/記録するs, films etc., but now a 重要な 部分 of the 責任/義務 is 存在 転換d to the 消費者 味方する, to the readers and テレビ視聴者s. Even WIPO 明言する/公表するs this fact in comment 3.06: "In 伝統的な publishing, copies are first 製造(する)d and then 分配するd. In electronic 出版(物) through 網状組織s, copies are produced at the 受取人 end after the 行為/法令/行動する of dissemination."

Article 12 does 許す every country to make 確かな exceptions from the 提案するd 議定書, but only "in 確かな special 事例/患者s that do not 衝突 with the normal 開発/利用 of the work and do not unreasonably prejudice the 合法的 利益/興味s of the author."

The 数字表示式の 未来 連合, an 協会 of both 公式の/役人 and 私的な organizations, 含むing libraries and educators 同様に as the 科学技術の 部門, draws the 結論 that Articles 7, 10 and 12 would, "inhibit browsing on the World Wide Web; discourage construction of the 全世界の 遠隔通信s 網状組織 and its '接近 ramps;' and 本気で 危険にさらす the ability of individual nations to (手先の)技術 控除s from 義務/負債 for 望ましい 商売/仕事 and 教育の 目的s."

And not only 網状組織 出版(物)s would be 影響する/感情d. In contrast to printed 調書をとる/予約するs, which one buys once and for all, one would never have 完全に "bought" an electronic 調書をとる/予約する. A CD-ROM disk would be more expensive the more times its content was 接近d. Hardly something that will 刺激する reading and 開発.

The 支持するs for this 提案 say that "of course the copyright 支えるもの/所有者s would like 支払い(額) for their work."

Of course! That is not the problem.

The problem is, rather, that many of the 権利s that we have gotten used to in the analog world would, by the 鮮明度/定義 of reproduction 提案するd by WIPO, disappear. There would be no 権利 to send 利益/興味ing newspaper clippings in electronic form to a friend, no 権利 to re-sell a 数字表示式の 調書をとる/予約する, no 権利 to look at 多数伝達媒体を用いる 作品 before deciding to buy them.

This is an extreme 解釈/通訳 say the proponents. No businessperson in their 権利 mind would 完全に 禁止(する) 顧客 browsing before a 購入(する). "One would never be successful if one didn't show one's 製品s," said Ken Kay from the Creative Incentive 連合, 特記する/引用するd in the June 問題/発行する of Politics Now's Netwatch. But, によれば the 提案, 見解(をとる)ing - "making the work perceptible" - is 特に 含むd as an example of reproduction where 控除s would have to 規定するd in 地元の 協定s.

And, as everybody knows, not all 商売/仕事 people がまんする by fair 商売/仕事 morals. Take, for example, the Swedish fortune 探検者s in the company "支配(する)/統制する Alt 削除する" who 登録(する) known 商売/仕事s' domain 指名するs so that they can sell them 支援する for a price to the companies later on. There would no 疑問 be 脅迫者,不正手段で暴利を得る者s in the 産業 who would quickly 出資する on these sorts of ambiguities.

"The Internet is one gigantic copying machine," said David Nimmer, a Los Angeles lawyer, in an article in the 経済学者 of July 27th this year. Maybe so, but the Internet is also one gigantic 探偵,刑事 machine, for one finds stolen 構成要素 much more readily here than in the real world.

If one wants to find out whether a text has been 不法に 分配するd, all one has to do is use a search engine, Alta Vista for example, and search for a characteristic 公式化 and see if there are any 攻撃する,衝突するs. One will no 疑問 soon be able to do this with images 同様に, which are 蓄える/店d in long formatted strings of code.

On the Internet, it is customary to first ask the service provider to willingly 除去する the 保護するd 構成要素, rather than すぐに calling up McKenzie-Brackman. If those responsible do not willingly 従う, the server can be 削減(する) off from the Internet by the 内部の regulatory 機械装置s that 存在する. Last March a new such regulator was created: The 事実上の 治安判事, which is meant to 解決する 不一致s in a quicker, more 効果的な manner that is appropriate for the Internet community.

This is not to say that 伝統的な 合法的な 対策 would not be appropriate.

On the contrary. Many of the 罪,犯罪s that people are in an uproar over can be 起訴するd under 現在の 法律; the 配当 of child pornography, 名誉き損,中傷, etc. are no いっそう少なく 犯罪の if they are 行為/行うd on the Internet, than if they occur on TV or in print.

As editor of The Art 貯蔵所, I 始める,決める up pretty 従来の 契約s with the contributors. I buy the 許可 for one publishing occasion in The Art 貯蔵所. The に引き続いて is part of one of my 契約s (公式文書,認める that The Art 貯蔵所 is considered to be both a database and a 定期刊行物):

"The 許可 to publish 適用するs only to this 定期刊行物/database. Thus, reproductions of the 絵s may not be accessible in more than one electronic 定期刊行物/database at the same time, although the editor keeps backup copies of all of the content in The Art 貯蔵所, accessible to him or his co-労働者s only. The 可能性 of browsing 自由に at a library, the 選択 of photocopying for personal use or to 知らせる 同僚s, has long been a sort of lubricant in the (警察などへの)密告,告訴(状) 配当 機械/機構, which is 必須の to both acquire and 交流 knowledge, so that new ideas and new knowledge can arise. It is incredibly shortsighted to try to squeeze money out of an 努力する that can give 多重の returns later on, both for society 捕まらないで, and for the individual owner of the (警察などへの)密告,告訴(状) in question. I wonder, for example, if today Apple Computer does not 悔いる keeping the Macintosh operating system a secret for so long.

If 厳格な人 支配するs are now put into place, there is the question of whether abidance could be controlled at all. I believe that 法律s, in some instances, might 表明する a 合意 in society, where people 表明する a 株d moral understanding. Even if it is difficult to 監視する abidance to the 法律 in question, it could 機能(する)/行事 as a sort of ありふれた 声明, a manifestation. But then it should, of course, be something that has support in the public's general sense of 司法(官), i.e. that one should not sexually 乱用 children.

And in this general sense of 司法(官) 確かな 原則s should be 心にいだくd, such as the 原則 of public 接近 to 公式の/役人 記録,記録的な/記録するs, the freedom of (警察などへの)密告,告訴(状), and the freedom to 交流 knowledge. Vague 規則s of the type 提案するd would probably only serve to 減ずる the general 乗り気 to 尊敬(する)・点 法律s at all.

The individual 使用者s have no 代表者/国会議員s of their own in this 事例/患者. Libraries and librarians are on their 味方する, of course, and library 協会s are doing a good 職業 in forming public opinion on this 事柄. It is important, however, to realize that this is something that will 影響する/感情 not just 会・原則s and scientists, or 研究 and public libraries. The 関わりあい/含蓄s of this 提案 will find their way into each and every home. Each and every home computer, every laptop computer, even portable 音声部の CD players equipped with "skip 保護" memory, and 数字表示式の videoplayers, all of it would turn into 可能性のある 道具s for 罪,犯罪. Without licensing and 支配(する)/統制する, they would become 小型の destilleries, producing 違法な reproductions of 保護するd 作品, a sort of 数字表示式の moonshine.

If one is an Uncle Scrooge, with dollar 調印するs for 注目する,もくろむs, then of course uncontrolled reproduction for personal use must be regarded as an enormous, unexploited market. The 申し立てられた/疑わしい 動機 behind controlling this market 同様に, is said to be that if the copyright owners receive more money, then there is a greater incentive for them to create new 作品 that the public can enjoy. Perhaps, perhaps not; for more than likely, it would become more expensive to subscribe to Internet services and to 購入(する) CD-ROM 製品s.

Internet 開拓する, Vint Cerf, the former 大統領,/社長 of The Internet Society, and now with MCI, said in May, によれば the Washington 地位,任命する, that the 国家の (警察などへの)密告,告訴(状) 組織/基盤/下部構造 Copyright 保護 行為/法令/行動する then 存在 提案するd could 軍隊 service providers to 増加する prices 劇的な, ーするために cover their 経済的な 義務/負債s.

Until now, it has been practical, even for the maximalists (支持者s of the most stringent 支配(する)/統制する and 規則 possible) to 許す fair use and copying for personal usage. For how could it 規制するd? With copyright police knocking on doors? Hardly. But in our 数字表示式の age, the maximalists have 設立する a 道具 that is neater and いっそう少なく reminiscent of old Soviet style. The computer. Everybody probably remembers Microsoft's 登録 wizard? A 類似の 機能(する)/行事 could 登録(する) 正確に/まさに what is happening on everybody's hard 運動s.

Another question is how many reproductions should be considered to be created when a computer program is in use. Article 4 equates computer code in a program to a literary work. As a result, a reproduction of this work is considered to be created every time it is read into a computer's working memory. But によれば article comment 7.12, a reproduction is, in 原則, also created even when parts of the work are copied (the thought 存在 that 結局 the entire work could be transferred over and 再建するd). Fragments of programs are 絶えず 存在 transferred in and out of 内部の memory when a computer is operating. So, the 税金 メーター would have to be operating almost as quickly as the 加工業者 itself.

The 責任/義務 of the Service Providers

Articles 10 and 7 of the WIPO 提案 示唆する that those who 供給する space on a server on the Internet are also responsible to 確実にする that copyrights are not 侵害する/違反するd. This is a difficult 状況/情勢 to 解釈する/通訳する, however. The 境界s between communication and publishing are not (疑いを)晴らす. Is a service provider responsible only for the 構成要素 it publishes or is it also 責任がある items that are 蓄える/店d 一時的に, for shorter or longer periods of time, on its server?

In the above について言及するd Washington 地位,任命する article, Vint Cerf said that, "the architecture of the Internet, the 容積/容量 of traffic it carries, 連邦の privacy 法律s, the 量 of copyrighted 作品, and the 合法的な 複雑さ of copyright 法律," make 監視するing and policing a provider's 網状組織 for (規則などを)破る/侵害するing 構成要素 impossible.

If service providers were to be 重荷(を負わせる)d with the 責任/義務 for what was on their servers, then 確かな companies would also have a good pretext for reading their 従業員's 私的な e-mail, so that no unauthorized reproductions of copyright 保護するd texts could be 交流d, either within the 内部の 網状組織 or externally.

Databases and the Extraction of Data

In a special 提案 regarding a 条約 for databases, which will also be 現在のd in December, article comment 2.05 equates data extraction with copying and reproduction. Extraction is defined as "the 永久の or 一時的な 移転 of all or a 相当な part of the contents of a database to another medium by any means or in any form." But a "相当な part" can be rather little as is 示唆するd in comment 2.10 where it 明言する/公表するs: "によれば item (v), '相当な part' means any 部分 of the database, '含むing an accumulation of small 部分s'".

The 数字表示式の 未来 連合 believes that, at least in the 部隊d 明言する/公表するs, this could mean that 引用するing something as trivial as a domain 指名する would 構成する an 違反 of 権利s, as would the usage of 定期的に occurring 科学の look-up (米)棚上げする/(英)提議するs which are 利用できる in electronic 判型.

In the most 悲観的な シナリオ, any form of quotation of an electronic source could be 違法な. It would 平行の what the Swedish Data 査察 Board long (人命などを)奪う,主張するd, that every machine searchable 指名する 構成するd a person registry which, in turn, meant that every newspaper article that was written on a computer and which 含む/封じ込めるd personal 指名するs was a de facto database, for which 合法的な 許可 was 要求するd. This new 保護 of databases would mean that every 引用する from an electronic text could, in the worst 事例/患者 シナリオ, be defined as an extraction from a database. The 事例/患者 stands or 落ちるs on how one defines a database.

In a letter of November 7th to Dr. John H. Gibbons, the Assistant to the 大統領 for Science and 科学(工学)技術, 代表者/国会議員s of 目だつ American library organizations (協会 of 研究 Libraries, American Library 協会, American 協会 of 法律 Libraries, 医療の Library 協会 and the Special Libraries 協会) said the に引き続いて:

"There is a long tradition in the 部隊d 明言する/公表するs of 保護するing 表現 but not the facts. This tradition is based on an 評価 that such a 政策 刺激するs 革新s in the public and 私的な 部門s, supports the 教育の 過程, and '促進する[s] the 進歩 of Science and the Useful Arts.' In the general WIPO 提案, there is also a section regarding databases, Article 5. Strangely enough, there it says that, "this 保護 does not 延長する to the data or the 構成要素 itself." May the discussions resound loudly in Geneva this December!

抗議するs Against the 提案

In most 事例/患者s, it is the worrisome, 貧しく thought out and 激烈な 規則s in the WIPO 提案 that are meant to 適用する 一般に, while the more reasonable modifications and sound 控除s are 放棄するd to the 地元の 交渉 partners in every country. Such is the 事例/患者 with the 権利 of reproduction for personal use, 同様に as with the 可能性 for "second-手渡す" sales (Article 8), etc.

研究, education and 商売/仕事 are ますます 存在 行為/行うd across all 境界s 経由で 全世界の 網状組織s. The readers of electronic on-line 出版(物)s are often spread throughout many countries, and even that which they read can be spread across the globe. This very article has 言及/関連s in the form of links to servers in the 部隊d 明言する/公表するs, Sweden and Chile. Copyright 法律s of today have an 完全に new topology in which to operate, an almost utopian 存在, in the 初めの sense of the word, meaning 'having no place'. Therefore, it would be of serious consequence not to 調和させる even the exceptions. さもなければ, the thousands of international man-hours spent in the work に向かって harmonization were a 完全にする waste of time. In the worst 事例/患者, they will count as an アリバイ for 国家の arbitrariness; perhaps a malignant form of arbitrariness in 明言する/公表するs with a いっそう少なく tolerant 態度 に向かって 伝統的な ideals of freedom, such as freedom of (警察などへの)密告,告訴(状) and of the 圧力(をかける).

The 王室の Swedish Library has 表明するd its 保留(地)/予約s in a letter to the Swedish 省 of 司法(官). The library considers WIPO's 提案 to be "不明瞭な and insufficiently thought out" and it recommends that the 提案 be 許すd to 残り/休憩(する) for, "a period of 分析 and discussions with 代表者/国会議員s of the 使用者 味方する", in other words, with all of us who partake of copyright 保護するd (警察などへの)密告,告訴(状).

Frans Lettenström, of the Swedish 王室の Library, 示唆するd a position on this 問題/発行する before the 連合 Internationale d'(警察などへの)密告,告訴(状) et de Documentation at a 会議/協議会 in Graz, Austria, at the end of October of this year. In the final 文書, the FID の中で other things, 明言する/公表するs that "the 役割 of society's collectors and disseminators of knowledge (such as libraries, 古記録s, museums and other (警察などへの)密告,告訴(状) 操作者s) might be destroyed", and recommended that the 投票(する)ing regarding Articles 5, 7, 10, 12 and 13 should be 延期するd by at least six months for その上の discussions の中で 使用者s, 特に people within the library and teaching communities.

On November 4th, 代表者/国会議員s for library organizations and the 遠隔通信s 産業 wrote a letter to the 大統領 of the European (売買)手数料,委託(する)/委員会/権限, Jacques Santer, in regards to the WIPO 提案. The letter calls the 提案s "unripe" and the signers 表明するd their 恐れるs that "the true 商業の and social 可能性のある of 網状組織d 数字表示式の 科学(工学)技術 may never be fully realised if the international 法律s of copyright are 修正するd in a way that fails to adequately 高く評価する/(相場などが)上がる the very essence of how the GII 現実に 機能(する)/行事s".

権利. One must realize the essence of that which is new. In the 15th century, Angelo Poliziano of Florence was …に反対するd to the 発明 of the printing 圧力(をかける): "The most simpleminded ideas may now in an instant be 再生するd in thousands of copies and be spread abroad." Sounds familiar? Had the 修道士s had 保守的な 貿易(する) unions at the time, they probably would have 需要・要求するd that printed 調書をとる/予約するs cost as much as handwritten ones, and that they could not be printed in more than one copy.

On its homepage, the International 連合 of Library 協会s and 会・原則s (IFLA) points out that copyright is something that can 刺激する 知識人 activity and should not 妨げる 接近 to (警察などへの)密告,告訴(状) and ideas. It その上の 明言する/公表するs that ideas that are accessible digitally, should not be made accessible only to those who can afford to 支払う/賃金. "Unless librarians and individual end 使用者s have (疑いを)晴らす 権利s, without prejudice to the 合法的 利益/興味s of 権利s owners, this will create a greater divide between the (警察などへの)密告,告訴(状) rich and the (警察などへの)密告,告訴(状) poor," 令状s the IFLA, reminding us of a classic tenet of 全世界の/万国共通の education.

Through time, from Andrew Carnegie, who built libraries, to H.G. 井戸/弁護士席s, who 想像するd a 全世界の 全世界の/万国共通の brain, to Ted Nelson, who laid out his hyper universe, Xanadu, many people have had grandiose 見通しs for 全世界の/万国共通の education. When we are now standing on the threshold of making all this possible, it would be paradoxical if everything was stopped by something so unnecessary as good ideas 存在 realized in a bad way.

Of course the copyright 法律制定 should be modernized and 調和させるd. Just not like this.
